Welcome to the Delaware Prescription Monitoring Program (PMP). The Delaware Prescription Monitoring Act (16 Del. C.§ 4798) authorizes the Office of Controlled Substances (OCS) in the Delaware Division of Professional Regulation, to establish, maintain and monitor the Prescription Monitoring Program in order to reduce misuse of controlled substances in Delaware and to promote improved professional practice and patient care.
What is the PMP System?
The PMP is a system that collects information on all controlled substance (schedules II-V) prescriptions. Using the PMP website, Delaware-licensed pharmacies and prescribers who dispense controlled substances report prescription data to the PMP daily. Prescribers and dispensers registered with the PMP can obtain immediate access to an online report of their current or prospective patient's controlled substance prescription history. This PMP website is available 24/7 and is to be used for healthcare purposes only.
HIPAA Warning
HIPAA and all confidentiality and non-disclosure provisions of Delaware law apply to the data in the PMP system. All PMP users must comply with HIPAA Privacy Rule Requirements. Inappropriate access or disclosure of this information is a felony under Delaware law and may result in criminal prosecution.
Pharmacies and prescribers are not permitted to distribute prescription history reports from the PMP system to the patient. Patients may request their own PMP prescription history records directly from the Delaware Division of Professional Regulation. See Request for Prescription Records.
FAILURE TO ABIDE BY ALL APPLICABLE FEDERAL HIPAA AND STATE PRIVACY LAWS COULD LEAD TO DISCIPLINARY SANCTIONS, WHICH MAY INCLUDE FINES AND/OR CRIMINAL PROSECUTION. |
