What are the application prerequisites?

Answer: You must reside in Delaware.

What if I don’t live in Delaware?

Answer: You must be a resident of Delaware to be considered.

Do I have to be a lawyer?

Answer: No.

Do I have to know Delaware law?

Answer: The examinations do not include questions on Delaware law.

What if I can’t take the exam on the designated date?

Answer: If you are unable to appear for the exam on the scheduled date, the exam will not be rescheduled regardless of the reason for your absence. If you appear but are unable to complete it, the exam will not be rescheduled.

What should I study for the tests?

Answer: The first exam measures attributes associated with successfully performing the duties of a magistrate, such as reading comprehension, judgment and reasoning, general mental ability and critical thinking.

How will my exam results be used?

Answer: Applicants will be ranked by county of residence. The Committee will then determine a minimum ranking for each county and interview those applicants who attained the minimum ranking.

If I get this appointment, will I have to work anywhere in Delaware?

Answer: If you pass the screening process and are appointed and confirmed for a Justice of the Peace  position, you will be assigned to a court in your county of residence.

I took the examination during the last screening. Do I have to take the exam again?

Answer: Yes.   You must submit a new application and re-take the examination. Even if you were recommended for possible appointment at the end of the last screening, you must re-apply and take the examination.
